In short
- Only advertise jobs that are real, open, and yours to fill. No test adverts, no "collecting CVs for later".
- Never charge a candidate any fee, for anything, in any country.
- Candidate CVs are confidential: use them only for the vacancy you received them for, and never pass them on.
- Publishing a vacancy and hiring through us is free for now. If we ever introduce a fee, we will agree it with you in writing before you use the service again. Consultation and CV review are separate services, invoiced separately.
- Adverts are published in neutral wording. We do not print requirements about nationality, gender, age, marital status, religion or photographs.
1. Who these terms are between
These terms apply between QualityJob4U (qualityjob4u.com) ("we", "us") and any company, agency or person who posts a vacancy with us, receives candidate details from us, or holds an employer account ("you"). The operating company is Ashraf For Business SPC. They apply from the moment you send us a vacancy or receive a CV from us, whichever happens first.
2. The vacancy must be genuine
This is the rule we care about most, because candidates give up their time and their personal data on the strength of your advert. By posting or sending us a vacancy you confirm that:
- the role actually exists and is open now, or is firmly expected as part of a project you have won;
- you have authority to recruit for it, either as the employer or as the appointed agency;
- the details are accurate: location, duration, rotation, contract type, experience required, certificates required, and pay information where it is given;
- if pay is stated, it is the pay you intend to offer, and any allowances, accommodation, flights or overtime are described honestly;
- the role is not posted to gather CVs for a future project, to test the market, to build a database, or to advertise a training course;
- you will tell us as soon as the role is filled or cancelled, so we can close the advert and stop wasting candidates' time.
We check adverts before publishing. We may ask for proof of the project, the client or your trade licence, and we may refuse or remove an advert at any time. Repeated adverts that turn out not to be real will end your access.
3. Candidates never pay
- You must not charge, or allow anyone in your supply chain to charge, a candidate any fee for a job, an interview, a visa, a medical, testing, training, accommodation, transport, "processing" or "registration", anywhere in the world.
- This follows ILO Convention 181 and the law of the countries where our candidates and clients are, including Oman, the Gulf states, the United Kingdom, the European Union, India and the Philippines.
- Any recruitment costs of the kind that the law places on the employer remain yours.
- If we learn that a candidate was charged, we will stop working with you immediately, tell the candidate, and report it where the law requires.
4. Candidate information is confidential
- Use a CV only to assess that candidate for the vacancy we sent it for.
- Do not pass it to another company, another group entity, a client of yours or any third party without our written agreement and the candidate's.
- Do not add candidates to your own database, mailing list or talent pool for other purposes.
- Do not approach the candidate through another route to avoid our fee. See section 6.
- Keep CVs secure, and delete them when your recruitment for that vacancy ends, unless you have hired the person or the law requires you to keep them.
- Until you have accepted these terms, we send CVs without the candidate's contact details.
5. What this costs you
Nothing for now. Publishing a vacancy, receiving candidates and hiring them through QualityJob4U is free for now. Consultation and CV review are separate services: they are not part of the free offer and are invoiced separately.
If we introduce a fee in future, we will tell you in writing first and agree it with you before you use the service again. No fee will ever be charged for a hire made before we agreed it with you, and nothing will ever be charged to a candidate.
6. Introductions
An "introduction" means we sent you a candidate's CV or details, or the candidate applied to your advert on our website. Please tell us when you hire someone we introduced, even though there is no fee today, so that we can keep our records straight, follow up with the candidate and close the advert.
7. If a placement does not work out
If someone we introduced leaves soon after starting, tell us and we will look for a replacement. We cannot promise a replacement, and because there is no fee today there is nothing to refund.
8. Adverts and equal treatment
- Adverts are published in neutral wording. We do not print requirements about nationality, gender, age, marital status, religion or photographs, even when a client asks, because such adverts are unlawful in many of the countries our readers live in.
- Where your own law allows a genuine occupational requirement, tell us privately and we will handle it in screening, not in the public advert.
- Where the law requires pay information in an advert, we will publish it.
- You are responsible for the accuracy and lawfulness of the content you send us.
9. Data protection
- When you receive candidate data you decide how you use it, so you are a separate controller in your own right, not our processor.
- You must comply with the data protection law that applies to you, give candidates your own privacy information, keep the data secure, and honour their rights.
- If a candidate withdraws consent or asks to be deleted and we tell you, you must delete their data unless the law requires you to keep it.
- Where personal data moves between countries, each of us is responsible for having a lawful basis for our own transfers. Where we transfer data to you outside the EEA or the UK, the European Commission's Standard Contractual Clauses (and the UK Addendum) apply to that transfer and are incorporated into these terms by reference, with QualityJob4U as data exporter and you as data importer.
- Tell us without delay, and in any event within 24 hours, if candidate data you received from us is lost, exposed or accessed by someone who should not have it.
10. Your account
Keep your login details secure and tell us if someone else has used your account. Everything done through your account is treated as done by you. We may suspend an account for non-payment, for breaking these terms, or where an advert appears not to be genuine.
11. What we do and do not promise
We will use reasonable care to find suitable candidates, and we check the information candidates give us as far as is practical. We cannot guarantee that a candidate will accept a role, stay in it, perform well, or hold valid certificates: you remain responsible for your own checks, including verifying certificates with the issuing body, right-to-work and visa eligibility, medicals, references and any client approval process.
12. Our responsibility
We are not liable for indirect or consequential losses, lost profits or lost production. Our total liability for any claim is limited to the fees you paid us for the placement concerned in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
13. Sanctions
Neither of us will use these services where doing so would breach sanctions or export control laws. We may refuse or stop work with any employer, project or country on that basis.
14. Term and ending these terms
These terms continue while you use our services. Either of us may end them with written notice. Ending them does not affect fees already due, the confidentiality duties in section 4, the introduction rule in section 6, or the data protection duties in section 9, which all continue.
15. Law and disputes
These terms are governed by the laws of the Sultanate of Oman. Subject to any court or procedure that mandatory law requires, the courts of Muscat have jurisdiction. Please raise any problem with us first at applications@qualityjob4u.com.
